Understanding DUI and DWI in Texas
In Texas, the legal term for drunk driving is Driving While Intoxicated (DWI). A person can be charged with DWI under Texas Penal Code § 49.04 if they operate a motor vehicle in a public place while:
Having a Blood Alcohol Concentration (BAC) of 0.08% or higher, or not having the normal use of mental or physical faculties due to alcohol, drugs, or a combination of substances.
Texas also recognizes DUI (Driving Under the Influence), but this charge is typically reserved for drivers under the age of 21 who operate a vehicle with any detectable amount of alcohol in their system.
Key BAC Limits in Texas

- 0.00% for drivers under 21 (zero-tolerance policy)
